Legal Commentary. This Georgia statute permits the Department of Driver Services to create and manage the motorcycle operator safety training program in order to license the operators in the State of Georgia. The state-wide motorcycle safety coordinator is permitted in this Georgia statute to create and manage additional training programs for motorcycle operator safety as needed.
This Georgia Law also provides that any programs created by the Department of Driver Services, or additional programs created by the state-wide motorcycle safety coordinator, must be based on the Motorcycle Safety Foundation Motorcycle Rider Course or a similar course in quality, utility and merit. The Motorcycle Safety Foundation is an “internationally recognized developer of the comprehensive, research based, Rider Education and Training System (MSF RETS)”. Once the motorcycle operator safety training program is completed by a motorcycle operator, the operator will receive a certification showing completion of the program under this Georgia law. This certificate is used by the operator to obtain the motorcycle class driver’s license in the State of Georgia.

Section 40-15-2 Authorization for Motorcycle Operator Safety Training Program; Certificate of Completion
(a)(1) The department is authorized to set up, establish, and operate a motorcycle operator safety training program for the purpose of assisting motorcycle operators to meet the requirements for licensed driving of motorcycles in this state.
(2) The coordinator, with the approval of the commissioner, shall be authorized to set up, establish, and operate additional motorcycle operator safety training programs.
(b) Any such programs shall provide courses on motorcycle operator safety. The programs shall be based on the Motorcycle Safety Foundation Motorcycle Rider Course or its equivalent in quality, utility, and merit.
(c) The department shall issue a certificate of completion to each person who satisfactorily completes the motorcycle operator safety training program.
