Georgia Low Speed Vehicle Traffic Laws (O.C.G.A. § 40-6-361)

Legal Commentary. This Georgia statute on low speed vehicles covers the proper usage of roadway or highway lanes of traffic. All low speed vehicles are allowed to use roadway lanes, including full use of the lane and no low speed vehicle should be overtaken by a motor vehicle, as defined in O.C.G.A. § 40-1-1(33). With this said, this also means that the low speed vehicle is required to use the full lane like a motor vehicle and not be operated in between lanes of traffic or between lines or rows of vehicles. If two or more low speed vehicles are being driven together, the two low speed vehicles can either be driven with one in front of the other or next to each other, each in its own lane, but not side by side in the same lane.

If a low speed vehicle operator desires to pass another vehicle, this Georgia code provides that the low speed vehicle should pass the vehicle in another lane of traffic, not in the same lane.

Section 40-6-361 Rules for Lane Use for Low-Speed Vehicles

(a) All low-speed vehicles are entitled to full use of a lane, and no motor vehicle shall be driven in such a manner as to deprive any low-speed vehicle of the full use of a lane.

(b) The operator of a low-speed vehicle shall not overtake and pass in the same lane occupied by the vehicle being overtaken.

(c) No person shall operate a low-speed vehicle between lanes of traffic or between adjacent lines or rows of vehicles.

(d) Low-speed vehicles shall not be operated two or more abreast in a single lane.
