Motor Carrier to Require Observance of Driver Regulations and Aiding or Abetting Violations (49 C.F.R. § 390.11 – 390.13)

Legal Commentary: These provisions set out that the duties and prohibitions imposed on drivers (even if the driver is also the motor carrier) must be observed and that anyone who tries to avoid or to violate the regulations is prohibited from doing so. These regulations effectively stop a motor carrier or driver from finding ways to avoid the important standards that the regulations impose. A motor carrier for example and its drivers cannot avoid compliance with these provisions.

§ 390.11 Motor Carrier to Require Observance of Driver Regulations

Whenever in part 325 of subchapter A or in this subchapter a duty is prescribed for a driver or a prohibition is imposed upon the driver, it shall be the duty of the motor carrier to require observance of such duty or prohibition. If the motor carrier is a driver, the driver shall likewise be bound.

§ 390.13 Aiding or Abetting Violations

No person shall aid, abet, encourage, or require a motor carrier or its employees to violate the rules of this chapter.
